Elgin Marriage License
Marriage license records for Elgin residents are handled at the county level, not by the city itself. Elgin sits across two counties, Kane and Cook, so the county you file in depends on where your ceremony will take place. Which County Handles Elgin Marriage Licenses
This is the first thing to figure out. Most of Elgin falls in Kane County, but a small part of the city extends into Cook County. Your ceremony location decides which clerk you visit. It does not matter where you live. Under 750 ILCS 5/203, the marriage license must come from the county where the wedding takes place. A Kane County license cannot be used for a ceremony on the Cook County side.

This is a common issue in Elgin because the county line runs right through parts of the city. Settle this detail before you pay any fees or fill out forms for your Elgin marriage license.
Elgin Marriage License Through Kane County
Most Elgin couples use the Kane County Clerk's office. The fee is $32 and they take cash only. No cards, no checks. Kane County runs two locations where you can apply.
The Aurora branch is the closer option for many Elgin residents. It sits at 5 E. Downer Place, Unit F, Aurora, IL 60505. The main office in Geneva is at 719 S. Batavia Ave., Building B. Both offices are open Monday, Tuesday, Thursday, and Friday from 8:30 AM to 4:30 PM, with applications cut off at 4:00 PM. Wednesdays run later, from 8:30 AM to 8:00 PM. The Kane County marriage license page lists current hours and any holiday closures. Both people must show up together. You cannot send one person to get a marriage license in Kane County.

Cook County Marriage License for Elgin
If your Elgin ceremony is on the Cook County side, you need a Cook County marriage license. The fee is $60. Cook County accepts cash, credit cards, and debit cards. That is a big difference from Kane County's cash-only rule. The Cook County Clerk's main office is in downtown Chicago at 50 W. Washington St., Room 301. There are also suburban branch offices. Cook County also lets you fill out the application online before your visit. The process still requires both people to appear in person with valid photo ID. Under IDPH guidelines, acceptable IDs include a driver's license, state ID, U.S. passport, or military ID. The Cook County fee is nearly double the Kane County fee, so it helps to know which side of the line your Elgin venue sits on before you go.
Elgin Marriage License Requirements
The rules are the same whether you file in Kane or Cook. Both applicants must be 18 or older. You each need a valid photo ID. Bring your Social Security number. You will also give your full legal name, date and place of birth, and current address. If either person was married before, bring proof that the prior marriage ended. A certified copy of the divorce decree or death certificate works. If the prior marriage ended less than six months ago, bring that proof with you to the Elgin marriage license appointment.
There is no blood test. Illinois stopped that in 1989. There is also no residency rule. You do not have to live in Elgin, Kane County, or even Illinois to apply. Anyone from any state or country can get a marriage license here, as long as the ceremony happens in the right county. Under 750 ILCS 5/212, you cannot marry if you are still in a prior marriage. Close blood relatives are also barred from marrying each other.

Marriage License Waiting Period in Elgin
Illinois has a one-day wait. Under 750 ILCS 5/207, the license takes effect one calendar day after it is issued. You cannot get married the same day you pick it up. Plan ahead. Get your Elgin marriage license at least two days before the ceremony.
The license stays good for 60 days. After that it expires and you have to apply all over again. It also only works in the county that issued it. A Kane County license is only good in Kane County. If you move your Elgin wedding from one county to the other, you need a new license from the right county clerk. This is one more reason to lock down your venue before you start the marriage license process.
After Your Elgin Marriage Ceremony
The officiant has 10 days to send the completed marriage certificate form back to the county clerk. This is required under 750 ILCS 5/209. Make sure your officiant knows this. Late returns delay the recording of your marriage in Elgin.
Once the clerk records the marriage, you can get certified copies. Kane County charges $16 for the first copy and $6 for each one after. Cook County has its own fee schedule for certified copies. You will need certified copies for name changes, insurance updates, and other legal matters after your Elgin wedding.
