Woodford County Marriage License Application

Go to the courthouse in Eureka. Both of you must be there. The Woodford County Clerk handles all marriage license applications in person during regular business hours. You cannot apply by mail or phone. Bring a valid photo ID such as a driver's license, state ID, passport, or military ID. The IDPH valid ID requirements page has the full list.

You will need to give your Social Security number, full legal name, address, date of birth, and place of birth. The clerk also asks for your parents' full names. Your mother's maiden name is part of the form. Under 750 ILCS 5/203, the clerk issues the license once both people sign the application and the fee is paid. The whole thing is done in one trip. You walk out with the license. No blood test is needed. That rule ended in 1989. There is no residency rule either, which means you do not have to live in Woodford County to apply.

Note: Call the Woodford County Clerk at (309) 467-2822 to check hours before making the trip to Eureka.

Requirements for a Woodford County License

Age is the first thing. Both people must be 18 or older. Under 750 ILCS 5/208, a person who is 16 or 17 can get a license if both parents consent. No one under 16 can marry anywhere in Illinois.

Prior marriages come up during the application. The Woodford County Clerk will ask when and where the previous marriage ended. If it ended within six months, bring a certified copy of the divorce decree or death certificate. Without it, the clerk cannot process your license. This is a statewide rule and one that surprises couples who recently got divorced. Have the paperwork in hand before you visit the courthouse in Eureka. You cannot simply tell the clerk about it and promise to bring it later. The document must be there at the time of the application.

Under 750 ILCS 5/212, you cannot marry if you are still in a prior marriage or civil union. Close blood relatives cannot marry. First cousins face restrictions based on age. The clerk reviews all of this during the application process at the Woodford County Clerk's office.

Woodford County Marriage License Fees

Marriage license fees vary by county. Call (309) 467-2822 to get the current rate for Woodford County. Across Illinois, fees run from $30 to $90. Some clerks only take cash. Others accept checks or cards. A small card processing fee may apply. The clerk's staff can tell you which payment methods work when you call.

Certified copies of the marriage certificate are a separate cost. After the officiant returns the signed form to the Woodford County Clerk, you can order copies in person or by mail. The Illinois Association of County Clerks and Recorders has a full directory of every county clerk office in the state. Wait Time for Woodford County Marriage License

One day. Under 750 ILCS 5/207, the license takes effect the calendar day after the clerk issues it. A judge can waive this in rare cases, but most people just plan ahead. Get your Woodford County marriage license at least two days before your wedding.

The license is good for 60 days from its effective date. After that it expires and you pay again. It only works in Woodford County. A license from Woodford County cannot be used in Peoria County, McLean County, or any other county. If your ceremony venue is not in Woodford County, you have to apply somewhere else. Check the venue's address carefully. Woodford County borders several counties, and it is easy to assume a venue is in one county when it is actually in another.

Note: The one-day wait cannot be waived by the clerk, only by a court order.
