Under 750 ILCS 5/203, the Cumberland County Clerk issues the license after both applicants sign the form and the fee is paid. Illinois does not require a blood test. There is no residency requirement, which means couples from Indiana, other Illinois counties, or any state can apply at the Toledo office.

Cumberland County Marriage License Timing
The license does not take effect right away. Under 750 ILCS 5/207, there is a one-day waiting period in Illinois. The marriage license becomes valid the calendar day after the clerk issues it. If you get the license on a Wednesday, the first day you can use it is Thursday. Plan to visit the Toledo office at least two days before your wedding.
Once issued, the license is good for 60 days. Let it expire and you start over. A new application and a new fee. The license only works in Cumberland County. It cannot be used in Coles County, Clark County, Crawford County, Jasper County, or Effingham County. This is a common point of confusion for couples in this part of Illinois because the counties are close together and venues sometimes sit near the border. Check with your ceremony location to confirm which county they are in before you apply for the license. Getting the wrong one means an extra trip to the right clerk's office and another fee.
Prior Marriage Details for Cumberland County
Were you married before? The Cumberland County Clerk needs to know. Tell Clerk Beverly Howard when the prior marriage ended and where. You need the date, the county, and the state of the divorce or death. If the prior marriage ended within the last six months, bring a certified copy of the divorce decree or death certificate to the Toledo office. Without that document, the clerk cannot issue a new marriage license if you fall in that time frame.

Who Can Get a Marriage License in Cumberland County
Both people must be 18 years old or more. Applicants aged 16 or 17 need parental consent. A parent or legal guardian must come to the Toledo office and sign the consent form right there in front of the clerk. Nobody under 16 can get a license in Illinois.
Certain marriages are not allowed under 750 ILCS 5/212. You cannot marry someone if you are still legally married to another person or in a civil union. The fee is $5. Mail a completed Application for Verification of Marriage Record to IDPH at 925 E. Ridgely Ave., Springfield, IL 62702-2737. Include a check or money order payable to the Illinois Department of Public Health and a legible copy of your photo ID.
